Court stops INEC from supervising PDP’s scheduled national convention

The Federal High Court sitting in Abuja presided by Justice James Omotosho has restrained the Independent National Electoral Commission, INEC from supervising, monitoring and recognsising the Peoples Democratic Party, PDP’s scheduled national convention.
The Court cited non-compliance with the relevant provisions of the law governing the conduct of congress as reasons for the restraint.

Justice Omotosho averred that there was no evidence sufficient enough to show that congresses were held at the states preluding the national convention, even as state congresses are fundamental to the national congress, a development that was contrary to statutory requirements.
According to the Judge, notices and correspondents were solely signed by the National Chairman without the National Secretary renders the exercise nugatory in the eye of constitution of the party and electoral laws.

Additionally, the Peoples Democratic Party, failed to notify the INEC 21 days ahead of scheduled as was required to allow the Commission to monitor the congress and meeting, hence, the whole plan was defective and steps taken in error.
Consequently, Justice Omotosho restrained INEC from monitoring, receiving, publishing, or recognising the outcome of the convention scheduled for November 15 and 16 in Ibadan, Oyo State, until full compliance with the law is ensured.
